Scope of Disclosures
These California Privacy Disclosures (the “California Disclosures”) supplement the information contained in our privacy policy and apply solely to individual residents of the State of California (“consumers” or “you”).
These California Disclosures provide additional information about how FormFactor, Inc. and its subsidiaries (collectively, “FormFactor,” “we,” “our,” or “us”) collect, use, disclose and otherwise process personal information of individual residents of the State of California, either online or offline, within the scope of the California Consumer Privacy Act (“CCPA”). We reserve the right to amend or change this Notice at any time. Any changes will become effective upon posting the revised Notice and/or providing it to you.
Unless otherwise expressly stated, all terms in these California Disclosures have the same meaning as defined in our privacy policy or as otherwise defined in the CCPA.
What is Personal Information?
When we use the term “personal information” in this Privacy Notice, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual or household. It does not include publicly available information or information that has been aggregated or deidentified and that is maintained in a form that is not capable of being associated with or reasonably linked to an individual person.
Our Collection and Use of Personal Information

In the last 12 months, we have collected the following categories of personal information from the categories of sources and for the purposes set forth below, which reference the personal information, sources and purposes described in the “How do we collect your information?” and “Why and on which legal basis do we collect and use your personal information?” sections of our privacy policy:

Use of Personal Information
We use the personal information we collect in the following ways:
- Analyze and improve our communications and strategies
- Operate, evaluate, secure, and improve our business
- Better serve you and personalize your experience
- Provide you with and manage access to our Services
- Enhance our Services
- Develop marketing and customer relationship management activities
- Enhance online security
- Prevent, investigate and respond to fraud or other illegal activity
- Comply with legal process and our legal obligations
- Facilitate business transactions
- Support investor relations
- As otherwise provided in our agreements with you
In the absence of a verifiable consumer request from you, we will retain your personal information for as long as we think is necessary to fulfill the purposes for which it was collected, and we reserve the right to retain it to the full extent permitted by law before automatically deleting (and directing our service providers to delete) it. Retention periods can vary based on the category of personal information, and we use criteria which include the following to determine the relevant retention period: contract requirements, operational needs, legally mandated retention periods, pending and potential litigation, historical archiving, and intellectual property or ownership rights.
We do not sell or share (cross-context behavioral advertising, under the CCPA) personal information that we collect or process.
Information Sharing
As described in the “With whom do we share your personal information?” section of the privacy policy, we disclose personal information within and outside of FormFactor for business purposes. We share the personal information we obtain as follows:
- Affiliates: we may disclose personal information to our corporate affiliates, parent(s), or subsidiaries.
- Service Providers: many of our service providers are located in the United States. We do not authorize service providers to use or disclose information except as necessary to perform services on our behalf or comply with legal requirements.
- Legal: We may disclose personal information (1) if we are required to do so by law or legal process (such as a court order or subpoena); (2) in response to requests by government agencies, such as law enforcement authorities, or where a referral to any appropriate local authority is required by law; (3) to establish, exercise or defend our legal rights; (4) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; (5) in connection with an investigation of suspected or actual illegal activity; or (6) as directed by your legal or authorized representative, where applicable
Your California Privacy Rights
California residents have the following rights under the CCPA:
- Right to Know and Access: You may request that we provide you with the following information about the information that is being collected about you, and how that information was used:
- The categories of personal information we have collected about you.
- The categories of sources from which the personal information is collected.
- The business or commercial purpose for collecting, selling or sharing personal information.
- The categories of third parties with whom the business discloses personal information.
- The categories of personal information that we sold or shared for a business purpose.
- The specific pieces of personal information we have collected about you. Upon your request, up to two times in a twelve-month period, we will provide you with a copy of the personal information we have collected about you.
- Right to Delete: You may request that we delete personal information collected from you (to the extent applicable and considering statutory exemptions);
- Right to Correct: You may request that we correct inaccurate personal information;
- Right to Limit: You may request, at any time, to limit our use of your sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services, and to other permitted purposes under the CCPA. If we collect sensitive personal information, we limit our use of the sensitive information to uses: (1) you have authorized, (2) that are required to fulfill any of your requests for goods or services, or (3) that are otherwise allowed by the CCPA;
- Right to Opt-Out: You may ask us not to sell your personal information, ask us not to use your personal information for cross-context behavioral advertising, and ask us not to use your personal information for profiling. We do not sell your personal information, and we do not use it for profiling or targeted advertising (share under the CCPA), and ask us not to use your personal information for profiling. We do not sell your personal information, and we do not use it for profiling or cross-context behavioral advertising (or sharing under the CCPA); and
- Right to be Free from Discrimination: You have the right not to receive discriminatory or retaliatory treatment by us because you exercise your privacy rights.
How to Exercise Your California Privacy Rights
To Exercise Your Right to Know or Right to Deletion
To exercise your right to know, correct, and/or right to deletion, please submit a request to [email protected] or by calling 800-919-6776. In compliance with CCPA we will require certain identifying information from you to verify your request. We will make our best efforts to respond to your valid request within 45 days from the receipt. We will need to verify your identity in order to respond to your request, which may involve confirming your California residency and/or reviewing your government identification. If you do not verify your identity, we cannot respond to your request. In some instances, we may be required to continue to retain or disclose portions of your personal data to comply with regulatory or legal obligations. Unless otherwise requested, any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. Under the CCPA, you may request that we disclose certain information to you about our collection and use of your personal information beyond the past 12 months. We, however, may decline to provide you that information if doing so would require a disproportionate effort on our part.
Updates to These California Disclosures
We will update these California Disclosures from time to time. If we make material changes to these California Disclosures, we will notify you by email to your registered email address, by prominent posting on our online services, or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided in the notification.
